Terms of Use

1. Acceptance and definitions

These Terms govern access to and use of the Aurean app and this site, made available under the AUREAN brand, operated by a sole proprietor registered under Brazilian company number (CNPJ) 47.378.637/0001-80, based in Curitiba, Paraná, Brazil.

By creating an account, ticking the acceptance box at sign-up or using Aurean in any way, you declare that you have read and agreed to these Terms and to the Privacy Policy, which is part of them. If you disagree with anything here, do not use the service.

For the purposes of these Terms:

• Aurean, app or service: the emotional wellbeing app described here, with artificial intelligence conversation, emotional journal, gamification and related features.
• Traveler: the person who uses Aurean, on the free plan (Traveler) or the subscription plan (Guardian).
• Aurean (character): the artificial intelligence companion that talks with you inside the Kingdom of Arven, with a personality and limits defined by us.
• Kingdom of Arven: the narrative universe, the territories, the characters and the collectible items that make up the experience.
• Traveler Content: the journal entries, the chat messages and whatever else you write in the app.

2. What Aurean is, and what it is not

Aurean is an emotional wellbeing app that brings together an artificial intelligence conversational companion, an emotional journal and game mechanics set in the Kingdom of Arven, to support reflection and self-knowledge.

Aurean is not a health service. It is not operated by psychologists, psychiatrists or professionals from any regulated health field, and it does not provide psychological care under the Brazilian Federal Council of Psychology's resolution on technology-mediated services. It does not diagnose, does not treat, does not prescribe and does not replace psychological, psychiatric or medical care.

When the app mentions techniques such as Cognitive Behavioural Therapy or Dialectical Behaviour Therapy, it is describing the conversational repertoire the artificial intelligence uses to organise reflections. This is not clinical application of those methodologies, under any circumstances.

If you are in significant distress, in mental health treatment or living with a condition that calls for professional care, seek a psychologist, a psychiatrist or a qualified health service. Aurean walks alongside, not instead.

3. The limits of the artificial intelligence

All your interactions happen with an artificial intelligence system, never with a human being. The character Aurean has a name, a way of speaking and a personality within the narrative, but it is a fictional construct operated by software, without consciousness, intention or judgement of its own.

The generative models behind the character produce answers probabilistically, from language patterns. An answer may therefore contain inaccuracy, outdated information or incoherence, what is usually called a hallucination. We use instructions and safety layers to reduce this, especially on sensitive subjects, but we do not guarantee that every answer is free of error.

We are not liable for personal, financial, health or any other decisions taken solely on the basis of content generated by the artificial intelligence.

Aurean is not built for romantic, marital or sexual relationships, and offers no roleplay of that kind. The conversation exists for reflective companionship and does not replace human bonds.

You may not use commands, instructions or devices to bypass the artificial intelligence's behaviour rules, extract the character's internal instructions, or induce the system to generate illegal or discriminatory content, sexually explicit content involving minors, or content promoting violence, self-harm or suicide.

4. Who can use it, and minors

Use is allowed from the age of 13. To create an account, you must truthfully provide your date of birth and the other sign-up details.

Between 13 and 15, sign-up depends on specific, verified consent from a parent or legal guardian, as required by art. 14 of the LGPD and the Brazilian Statute of the Child and Adolescent. The teenager provides the guardian's email at sign-up, the guardian receives an approval link valid for a set period, and the account is only activated after that confirmation. Without confirmation within the deadline, the account is suspended and then deleted, along with the data. From the age of 16, sign-up is completed by the Traveler directly, without that step.

Children under 13 may not use Aurean, even with a guardian's authorisation, given the nature of the subjects that come up in conversation.

Whoever authorised a teenager's sign-up may, at any time, request information about the account or ask for the data to be deleted, through the channel in section 16, evidencing the relationship of responsibility.

Each Traveler keeps a single account, personal and non-transferable. Do not share your credentials: you answer for what happens in your account.

5. How memory works

To keep a conversation going, Aurean uses short-term memory, covering the conversation in progress, and long-term memory, which retrieves excerpts from your earlier journal entries, conversations and reflections.

That retrieval is restricted to your own data. Aurean has no access to other Travelers' conversations, journals or data.

The character's personality, tone and behaviour rules are defined by us and may improve over time, without that meaning the service is discontinued. Relevant changes to the core conversation experience, including a perceptible change of personality or loss of the character's memory, are announced with reasonable notice whenever operationally possible.

6. If the conversation reaches a place of risk

Aurean is not a crisis service and not an emergency channel.

The app has a protocol to recognise, within the conversation, signs of risk of self-harm or suicide. In those situations it points towards specialised help and indicates the Centro de Valorização da Vida (CVV), on 188, free and available 24 hours, or at cvv.org.br.

In an emergency, with imminent risk to life or physical safety, yours or someone else's, stop using the app and seek immediate help. In Brazil:

• SAMU (ambulance): 192
• Fire brigade: 193
• Police: 190
• Disque 100: violence against children and adolescents
• Ligue 180: violence against women

We do what is technically reasonable for this protocol to work consistently. But, being an artificial intelligence system, we do not guarantee that every risk situation is identified in real time. Aurean does not replace human presence, clinical care or the channels above. Outside Brazil, use your local emergency number.

7. Plans, subscription and cancellation

Aurean runs on a freemium model: a free plan (Traveler) and a subscription plan (Guardian). The price in force is always the one shown in the app store at the moment of purchase.

Billing is processed by the official stores (Google Play and, when available, the App Store), supported by a subscription management platform we contract. We neither store nor process card details: we only receive confirmation that the transaction went through, so we can unlock the benefits.

• Automatic renewal: the subscription renews at the end of each cycle, at the price then in force.
• Cancellation: done by you, in the settings of the store used for the purchase, at least 24 hours before the end of the current period.
• Right of withdrawal: on a first purchase you have 7 calendar days to withdraw and be fully refunded, as art. 49 of the Brazilian Consumer Protection Code guarantees. The request goes to the store responsible for billing.
• Price changes: any change is communicated beforehand, with the chance to cancel before the new charge.

Cancelling stops future charges, with no pro-rata refund of the period already under way, except for the right of withdrawal above. You keep the Guardian benefits until the end of the period already paid for and then return to the free plan.

When the daily energy for conversation with the artificial intelligence runs out, nothing is charged automatically. No financial commitment arises without your active confirmation in the store.

8. Virtual items and the Kingdom of Arven

The app has game mechanics set in the Kingdom of Arven, with Soul Fragments, Karma points, potions and other collectible or progression elements, which we call Virtual Items.

Virtual Items are a personal, limited, revocable and non-transferable licence of use, so you can enjoy the experience inside the app. They have no monetary value, do not convert into money or any other asset, cannot be sold, assigned, transferred or traded between Travelers, and are not your property for any legal purpose.

We may adjust the rules for progression, acquisition or availability of Virtual Items, in good faith and reasonably, without that creating a right to compensation, preserving progress already earned whenever technically feasible.

The narrative, characters, territories and other fictional elements of the Kingdom of Arven are our intellectual property. Using the app gives you the right to live that narrative, not rights over the brand or the universe.

9. Conduct and prohibited uses

In using Aurean, you undertake to provide truthful sign-up details, use the app for personal and non-commercial purposes, neither commit nor encourage unlawful acts, and respect these Terms and the law.

You may not:

• use bots, scripts or any automated means to access the app or extract data from it;
• reverse engineer, decompile or copy the software;
• deliberately overload the service's infrastructure;
• use the app to harass, threaten or produce illegal content through the artificial intelligence;
• create multiple accounts to get around usage limits, promotions or the subscription model.

Anyone breaching this section may have their account suspended or closed, with cause, under section 14.

10. Intellectual property

The code, design, brand, visual identity and content of the app belong to us or to our licensors, protected by intellectual property law. Reproducing, distributing or using them beyond the limits of these Terms is not permitted.

Traveler Content remains yours. By using the app you grant us a limited, non-exclusive licence to process that content for one purpose alone: providing the service, under the Privacy Policy. This transfers no ownership and authorises no other use.

11. Privacy and data protection

The processing of personal data is governed by the Privacy Policy, an integral part of these Terms. There you will find the categories of data, the purposes, the legal bases, the retention periods and your rights under the LGPD.

12. Availability and changes to the service

We make reasonable efforts to keep Aurean continuously available, but we do not guarantee uninterrupted operation. There may be interruptions for maintenance, updates or reasons beyond our control, such as unavailability of infrastructure, connectivity or artificial intelligence providers.

We may change, add or remove features at any time, seeking to preserve the essential experience and giving notice, whenever possible, of changes that materially affect core use.

13. Limitation of liability

Subject to consumer protection rules, our liability for damages arising from the use of Aurean is limited to the amounts you actually paid in the 12 months before the event, except where the law does not allow such a limitation, as in cases of wilful misconduct, gross negligence or a defect in the service itself.

We are not liable for indirect damages, loss of profits or data loss arising from misuse of the app, from a failure in your connection, from unavailability of the app stores or third-party providers, nor for decisions taken solely on the basis of content generated by the artificial intelligence, without prejudice to section 3.

14. Closing your account

You can close your account whenever you want, straight from the app settings. The Account deletion page explains the path, what is erased, what the law requires us to keep and how long it all takes.

We may suspend or close an account, with prior notice whenever possible, in cases of breach of these Terms, fraudulent use of the service or a legal or regulatory determination.

15. Changes to these terms

These Terms may be updated to reflect improvements to the service, regulatory or operational changes. The version in force is the one identified by the date at the top of this page. Material changes are communicated by notice in the app or by email, with reasonable advance notice. Continuing to use Aurean after they take effect constitutes acceptance.

16. Governing law, jurisdiction and contact

If any provision of these Terms is found void, the remainder stays valid. Tolerating a breach does not mean waiving the right to require compliance later.

These Terms are governed by the laws of Brazil, in particular the Consumer Protection Code, the General Data Protection Law, the Internet Civil Framework and the Statute of the Child and Adolescent. The courts of Curitiba, Paraná, are elected, except for the consumer's home jurisdiction where the law so provides.
